I want a case study about (Nancy Giraldo v. Southwestern Adventist University (2017)).
There have been in the past decades a number of lawsuits involving Adventist educational institutions, often with devastating impacts: Stress for the administrators, distraction from our mission (teaching and learning), division in the community, negative PR, considerable legal expenses covered by Adventist Risk management, and negative consequences on several educators’ careers. As we study these cases, we would like to
a) Raise awareness of the fact that our educational institutions have been spending millions of dollars in litigation.
b) Dispel the myth that every problem is resolved with prayer, pastoral counseling, and church board.
c) Encourage church and educational leaders to be responsible administrators, good stewards, prudent managers.
d) Encourage educational leaders to look for legal counsel when in doubt.
Your case study must include the following:
a) Complete case citation. Give the full citation for the case, including the name of the case, the date it was decided, and the court that decided it.
b) Important facts. Briefly indicate (a) the reasons for the lawsuit; (b) the identity and arguments of the plaintiff(s) and defendant(s), respectively; and (c) the lower court’s decision—if appropriate.
c) Key issues. Concisely phrase, in the form of a question, the essential issue before the court. (If more than one issue is involved, you may have two—or even more— questions here.)
d) Decision. Indicate here—with a “yes” or “no,” if possible—the court’s answer to the question (or questions) in the Issue section above.
e) Rationale. Summarize as briefly as possible the reasons given by the court for its decision (or decisions) and the case or statutory law relied on by the court in arriving at its decision.
f) Recommendations. What educational leaders could have done then (or could do in the future) to prevent or alleviate such situations?
You may also choose to include separate opinions, additional comments, and/or an analysis.
