Last week in the Residency, you began developing the structure of the Discussion section of your Memo and potential factual analogies you can make between the client facts and the case law.
Now, select 3-4 of the client facts that you feel are the most important facts for your Discussion. Ask yourself why you selected those facts–what reasoning from the court made these client facts seem important?
As you know,
QP = law + facts; and
BA = law + facts + reasons.
Create a list with two columns: in the first column, list “Facts for the QP/BA.”
In the second, list why these facts are important under the heading, “Reasons for BA.” You now have potential Facts and Reasons for your QP and BA.
Next, what facts may not be legally significant, but are important to tell the client’s story?
